These Terms of Service ("Terms") govern your access to and use of balmbeach.co and any related websites, services, features, content, and products operated by Earth Scents LLC ("Balm Beach," "Company," "we," "us," or "our").

By accessing or using our website, creating an account, placing an order, submitting content, or otherwise using our services, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you should not access or use the Site.
1. ELIGIBILITY
The Site is intended for users who are at least 18 years old or otherwise legally capable of entering into a binding agreement.
By using the Site, you represent that you have the legal capacity to agree to these Terms.
2. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our business, products, services, technology, or legal obligations.
When we make changes, we will update the "Last Updated" date at the top of these Terms.
Changes become effective when posted to the Site unless otherwise stated or required by applicable law.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, abuse our services, or otherwise create risk for Balm Beach or its customers.
5. PRODUCTS
Balm Beach sells personal care and skincare products, including tallow-based skincare products and deodorant products.
Products displayed on the Site are subject to availability.
We may modify, reformulate, discontinue, limit, or otherwise change products, product packaging, quantities, descriptions, pricing, or availability at any time.
We make reasonable efforts to display our products, packaging, colors, ingredients, and other characteristics accurately. However, actual appearance may vary due to manufacturing variations, product updates, photography, lighting, screen settings, or packaging changes.
Product descriptions are provided for informational purposes and should be read together with the product's packaging, ingredient list, directions, and warnings.
6. PRODUCT USE AND HEALTH DISCLAIMER
Unless expressly stated otherwise in legally compliant product labeling, Balm Beach products are cosmetic and personal care products and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
Information provided on the Site, including product descriptions, educational materials, blog posts, social media content, testimonials, reviews, guides, or other content, is provided for general informational purposes and is not medical advice.
Nothing provided by Balm Beach is intended to replace advice from a physician, dermatologist, pharmacist, or other qualified healthcare professional.
Individual experiences and results may vary.
You are responsible for reviewing product ingredients and determining whether a product is appropriate for you.
Discontinue use if irritation or an adverse reaction occurs. If you have allergies, sensitivities, an existing skin condition, or other medical concerns, consult an appropriate healthcare professional before using a product when appropriate.
Some Balm Beach products may be manufactured or handled in environments where ingredients used in other Balm Beach products are also present. Customers with known allergies or sensitivities should carefully review ingredient information and contact us with questions before use.
7. SUN PROTECTION DISCLAIMER
Unless a Balm Beach product is expressly labeled with an SPF value and marketed as a sunscreen in accordance with applicable regulatory requirements, it should not be relied upon to provide sun protection or used as a substitute for an appropriately labeled sunscreen.
Balm Beach makes no representation that a product without an expressly stated and properly tested SPF provides protection against sunburn, UVA or UVB radiation, skin cancer, premature skin aging, or other effects of sun exposure.
Customers should follow appropriate sun-protection practices and use properly labeled sunscreen when sun protection is needed.
8. ORDERS
By submitting an order, you are offering to purchase the products included in your order.
We reserve the right to accept, reject, limit, or cancel an order for legitimate business reasons, including:
- product unavailability;
- suspected fraud or unauthorized activity;
- incorrect pricing or product information;
- payment issues;
- shipping restrictions;
- inventory errors; or
- violations of these Terms.
An automated order confirmation does not necessarily constitute final acceptance of an order.
If we cancel an order after payment has been collected, we will issue an appropriate refund.
9. ORDER CHANGES AND CANCELLATIONS
Customers may request an order cancellation or modification within 24 hours after placing an order by contacting support@balmbeach.co.
We will make reasonable efforts to accommodate requests received within this period.
However, orders may enter fulfillment shortly after they are placed. For that reason, we cannot guarantee that an order can be changed or canceled, even if the request is made within 24 hours.
Once an order has been fulfilled, shipped, or otherwise entered a stage where it cannot reasonably be modified, the order may no longer be eligible for cancellation or modification.
If we cannot cancel an order, the customer may be eligible to return the product under our Refund & Cancellation Policy.
10. PRICING AND PAYMENT
Prices are displayed on the Site in the currency indicated at checkout.
Prices may change at any time without notice. Changes will not ordinarily affect orders that have already been accepted, except where necessary to correct an obvious pricing error or as otherwise permitted by law.
Applicable taxes, shipping fees, and other charges will be displayed during checkout when applicable.
You agree to provide current, complete, and accurate payment and billing information.
By providing a payment method, you represent that you are authorized to use that payment method and authorize us and our payment providers to charge the applicable amount.
We may use third-party payment processors to process transactions. Your payment information may therefore also be subject to the applicable processor's terms and privacy practices.
11. SHIPPING AND DELIVERY
Shipping and delivery estimates are estimates only and are not guaranteed unless expressly stated otherwise.
Delivery may be affected by carriers, weather, holidays, incorrect addresses, customs, supply conditions, or circumstances outside Balm Beach's reasonable control.
Customers are responsible for providing an accurate and complete shipping address.
If you experience a shipping issue, contact support@balmbeach.co and we will make reasonable efforts to assist you.
12. REFUNDS AND RETURNS
Balm Beach offers a 30-day money-back guarantee subject to our Refund & Cancellation Policy.
Customers who are dissatisfied with a qualifying Balm Beach product may contact us within 30 days of delivery to request a return or refund.
Products that arrive damaged, defective, broken, or incorrect are also covered as described in our Refund & Cancellation Policy.
Additional details, procedures, and eligibility requirements are contained in the Refund & Cancellation Policy posted on the Site, which is incorporated into these Terms by reference.
13. SUBSCRIPTIONS AND AUTOMATIC RENEWAL
Certain Balm Beach products may be offered through recurring subscription plans.
When you enroll in a subscription, you authorize Balm Beach and our payment providers to automatically charge your selected payment method for each recurring subscription order at the frequency and price disclosed to you when you enroll, until you cancel the subscription.
The applicable price, billing frequency, renewal terms, and other material subscription information will be disclosed before you complete your subscription purchase.
Subscription prices may change from time to time. Where required, we will provide notice of applicable price changes before they take effect.
Managing Your Subscription
Subject to the options available for your subscription, customers may:
- cancel their subscription;
- pause their subscription;
- skip an upcoming order; or
- change their delivery frequency.
There is no minimum subscription commitment unless expressly disclosed before enrollment.
Subscription Cancellations and Changes
To prevent an upcoming subscription charge or shipment, a cancellation, pause, skip, or applicable subscription change must be submitted at least 24 hours before the next scheduled billing date.
Requests made less than 24 hours before the scheduled billing date may not take effect until the following subscription cycle.
Once a subscription order has already been processed, cancellation of the subscription does not automatically cancel or refund that processed order.
Processed subscription orders remain subject to our Refund & Cancellation Policy.
Customers may manage their subscriptions through the subscription-management functionality provided through the Site or may contact support@balmbeach.co for assistance.
Canceling a subscription stops future recurring subscription charges after the cancellation takes effect.
14. SUBSCRIPTION PAYMENT AUTHORIZATION
By purchasing a subscription, you expressly authorize us to charge the payment method associated with your subscription on a recurring basis according to the frequency you selected.
You are responsible for keeping your payment information current.
If a recurring payment fails, we or our subscription/payment providers may attempt to process the payment again or contact you regarding the failed payment, subject to applicable law.
We may suspend or cancel a subscription if payment cannot be successfully processed.
15. PROMOTIONS, DISCOUNTS, AND COUPON CODES
Promotions, discounts, free gifts, coupon codes, bundles, and other offers may be subject to additional terms stated at the time of the promotion.
Unless otherwise stated, promotions:
- may have expiration dates;
- may be limited to certain products or customers;
- may not be combined with other offers;
- may be limited in quantity; and
- may be modified or discontinued where permitted by law.
We reserve the right to cancel or deny promotional benefits resulting from fraud, abuse, manipulation, or technical errors.
16. REVIEWS, PHOTOS, AND USER CONTENT
The Site may allow customers to submit product reviews, testimonials, photographs, videos, comments, feedback, or other content ("User Content").
You retain ownership of User Content that you own.
By submitting User Content to Balm Beach, you grant Balm Beach a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, display, distribute, adapt, resize, format, and otherwise use that User Content for purposes related to Balm Beach's business, including on our website, social media, advertising, emails, product pages, and other marketing materials, subject to applicable law.
You represent that:
- you own or have the necessary rights to submit the content;
- the content does not infringe another person's intellectual property, privacy, publicity, or other rights;
- the content is not intentionally false, misleading, defamatory, unlawful, or harmful; and
- any individuals identifiable in submitted photos or videos have provided any permissions legally required for the submitted use.
We may remove, decline to publish, or moderate User Content when appropriate.
Submitting a review does not guarantee that it will be published.
We will not condition publication of legitimate reviews on whether the review is positive or negative.
17. TESTIMONIALS AND CUSTOMER EXPERIENCES
Customer reviews and testimonials describe individual customer experiences.
Results and experiences may vary from person to person.
A testimonial or review does not constitute a guarantee that another customer will experience the same outcome.
We may feature customer reviews or testimonials in accordance with applicable advertising, endorsement, and consumer-protection requirements.
18. AFFILIATES AND CREATORS
Balm Beach may operate an affiliate, creator, ambassador, referral, or similar promotional program.
Participation in such a program may be subject to separate program terms.
Affiliates, creators, ambassadors, and other third parties are not authorized to make medical, therapeutic, regulatory, or other claims regarding Balm Beach products beyond claims authorized by Balm Beach and permitted by applicable law.
Statements made independently by third-party creators do not necessarily represent Balm Beach's views.
19. EMAIL AND SMS COMMUNICATIONS
If you voluntarily opt in to receive promotional emails or text messages from Balm Beach, we may send marketing communications in accordance with your consent and applicable law.
Consent to receive promotional SMS messages is not a condition of purchasing Balm Beach products.
Message and data rates may apply to text messages.
Where SMS marketing is offered, additional mobile messaging terms may apply. Customers will be provided with applicable opt-out instructions, including instructions for stopping promotional messages.
Transactional communications relating to orders, accounts, subscriptions, customer service, security, or other transactions may still be sent when necessary even if you opt out of promotional marketing, subject to applicable law.
20. INTELLECTUAL PROPERTY
The Site and its contents, including text, graphics, photographs, product images, videos, designs, logos, trademarks, trade dress, software, website layouts, graphics, and other materials, are owned by or licensed to Earth Scents LLC and are protected by applicable intellectual property laws.
You are granted a limited, revocable, non-exclusive, non-transferable right to access and use the Site for your personal, non-commercial use.
Except as permitted by law or expressly authorized by us, you may not:
- copy or reproduce Site content for commercial purposes;
- modify or create derivative works from our content;
- sell, sublicense, distribute, or exploit our content;
- scrape or systematically extract Site data;
- use Balm Beach trademarks or branding without authorization; or
- interfere with the Site's operation or security.
All rights not expressly granted are reserved.
21. PROHIBITED USES
You may not use the Site:
- for unlawful or fraudulent purposes;
- to violate applicable laws or regulations;
- to infringe intellectual property or privacy rights;
- to transmit malicious software or harmful code;
- to gain unauthorized access to systems or accounts;
- to scrape, crawl, or extract information through unauthorized automated methods;
- to interfere with the security or operation of the Site;
- to submit false, deceptive, defamatory, abusive, or unlawful content; or
- to engage in conduct intended to harm Balm Beach, its customers, or third parties.
22. THIRD-PARTY SERVICES AND LINKS
The Site may use or link to third-party platforms, applications, payment providers, subscription providers, social networks, shipping providers, or websites.
Balm Beach does not control all third-party services and is not responsible for their independent content, availability, security, or privacy practices.
Your use of third-party services may be governed by separate terms and policies provided by those third parties.
23. ERRORS AND INACCURACIES
The Site may occasionally contain typographical errors, inaccuracies, omissions, outdated information, or technical errors relating to product descriptions, pricing, promotions, availability, shipping, or other information.
We reserve the right to correct such errors and update information as appropriate.
If an error materially affects an order that you have placed, we will take reasonable steps to notify you and provide an appropriate remedy where required.
24. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE, ITS CONTENT, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
BALM BEACH DISCLAIMS WARRANTIES THAT MAY OTHERWISE BE IMPLIED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH WARRANTIES MAY LEGALLY BE DISCLAIMED.
WE DO NOT WARRANT THAT THE SITE WILL ALWAYS BE AVAILABLE, SECURE, UNINTERRUPTED, OR ERROR-FREE.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS WARRANTIES OR CONSUMER RIGHTS THAT CANNOT LEGALLY BE EXCLUDED OR LIMITED.
25. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EARTH SCENTS LLC AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SITE OR SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM A CLAIM RELATING TO A PARTICULAR PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID TO BALM BEACH FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.
These limitations do not apply to liabilities that cannot lawfully be excluded or limited, including where applicable certain rights relating to personal injury, product liability, fraud, gross negligence, intentional misconduct, or statutory consumer protections.
26. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Earth Scents LLC and its affiliates, owners, officers, directors, employees, contractors, and agents from claims, damages, liabilities, losses, or reasonable costs arising from:
- your unlawful or improper use of the Site;
- your material violation of these Terms;
- your User Content;
- your infringement of another person's rights; or
- fraudulent or unlawful conduct associated with your account.
This provision does not require a consumer to indemnify Balm Beach for Balm Beach's own unlawful conduct or liabilities that cannot legally be shifted to the consumer.
27. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles, except where applicable consumer-protection laws require otherwise.
Before initiating formal legal proceedings, we encourage you to contact us at support@balmbeach.co so that we can attempt to resolve the issue.
Subject to any rights or venue requirements that cannot legally be waived, disputes arising from these Terms, the Site, or your relationship with Balm Beach may be brought in the applicable state or federal courts located in or serving Clark County, Nevada.
You consent to the jurisdiction of those courts to the extent permitted by law.
Nothing in these Terms prevents either party from bringing an eligible matter in small claims court or exercising rights provided by applicable consumer-protection law.
28. SEVERABILITY
If any portion of these Terms is found to be invalid, unlawful, or unenforceable, that portion will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will remain in effect.
29. WAIVER
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
30. ASSIGNMENT
You may not assign your rights or obligations under these Terms without our prior written consent.
Earth Scents LLC may assign or transfer these Terms in connection with a merger, acquisition, restructuring, sale of assets, financing, corporate reorganization, or other legitimate business transaction, subject to applicable law.
31. FORCE MAJEURE
Balm Beach will not be responsible for delays or failures caused by circumstances outside our reasonable control, including natural disasters, severe weather, transportation interruptions, carrier delays, labor disruptions, government actions, internet or technology failures, supply shortages, or similar events.
32. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Refund & Cancellation Policy, and any additional terms expressly applicable to a specific service or promotion, constitute the agreement between you and Earth Scents LLC regarding your use of the Site and services.
